My reference is from pro BJ player Arnold Snyder's book "Blackbelt in Blackjack". He doesn't cite the court cases, but I trust him. Anyone who wants to learn more about the life of a professional BJ player should definitely check out his book. He describes various methods of avoiding heat from pit bosses and all the legal elements involved with card counting, such as if the casino is allowed to confiscate your chips, arrest you, etc. Very interesting read.
Also, he specifically states that laws may vary from state to state, but he knows his information certainly is correct for Nevada. And if you're involved with any legal trouble with casinos because of card counting to contact an attorney and fight your case - card counting is not illegal. There is no cheating involved.
