Insurance problem....ensuing life tilt.

Ok heres the problem, hopefully people have dealt with this shit before and can gimme a head up.
Backstory:
Driving home from FW, I get into an accident.
Accident was me at a dead stop behind some lady taking a left. Dood slams into my bumper. Call cops get police report, guy is a POS etc etc.
Get repairs done, no rental on my policy go for 3rd party rental.

File a claim through safeco to get a rental or at least reimbursement. They can't contact their insurer and thus cannot determine liability. He has yet to contact them and basically tell me if he doesn't my claim can be thrown out. I have faxed the police report and talked to numerous safeco reps and degraded everyone of 'em. Appraiser has yet to call me and does so tomorrow.

What is my course of action so I don't have to pay for the rental and my shit doesn't get thrown out?

cliffs:
Get hit by some fagball, 100% his fault.
He never files a claim and cannot be reached.
Safeco says my claim might get thrown out.
Course of action to stick it to these fucks?

The other party is responsible for the rental costs if he is at-fault. If your company can't get ahold of the person and their insurance carrier, then you're out of luck.
(It's not their problem)

Under/uninsured motorist does not apply to rental reim.

You should think about buying rental reimbursement (it's not that expensive) or going with a more reputable insurance carrier who would do a better job or tracking down the third party.
