Just to clarify, it already has happened. Jose Padilla (American citizen) was arrested in May 2002 (as a material witness), then in June, Ashcroft said he was an enemy combatant and transferred him to military custody. He was held without charge until November 2005. He was not allowed contact with an attorney until March of 2004. His case is still undecided as far as I know. Though Ashcroft said Padilla was planning to detonate a dirty bomb (and claimed that we had ample evidence), that was not included in the charges.

The Padilla case worries, unfortunately there is so little information on it I don't know what to make of it though. It would worry me more if padilla were politically active and not some punk.
