There's an important difference between now and WWII, in my mind: the "war" we're engaged in right now ... doesn't seem to have an end-point. There's no specific enemy, and no specific way we're going to know when the "war" is "over." There will always have been and always will be terrorists out there of one sort or another. So the war can go on forever.
The really new thing, though, which is truly scary, is the blatant disregard for the Constitution shown here by Gonzalez. He's not saying that the present conditions justify suspending habeas. He's saying that nobody ever has had habeas corpus rights. He's saying that the Constitution itself does not guarantee those rights.
FDR suspended them ... for a time ... because of a threat.
Gonzalez says you never had them. That's just seriously f*cked up.
