Alright mizor heres a question i oughta know the answer to, but i dont.
My roomate moved into our house on the 10th of july approximately. I offered him the opportunity to pay pro rated rent, to which he "nah its cool ill just pay for hte entire month". He did so. He then paid his full rent every subsequent month, and paid his full share of all those things which it was determined should be split between the roomates (utilities, etc.). We moved out of the place on approx Jan 10, at which time i asked him for his share of the rent for the month of january. At this point he says "I moved in on the tenth of july, and overpaid for that month, I shouldnt have to pay this", and i said "Well, I relied on the assumption that you were going to pay because i had every reason to think you would and no reason to think different, and i told the jew (thats the landlord) that all the rent would be left here for him when he got here and id rather not pissim off and jeopardize the $6k in securiy deposits we have down on the place..." [banks were closed and i had to leave town]
Who prevails and why? And how ought i try to deal with this situation given the fact i had about ten minutes while sittin on the sidewalk to do so?
