Okay - now that I've muddied up the water enough with my outs conversation - let's go back to the hand at hand - fold...

(though instinctively, I think this is still a pretty close call. If it were limit of course - we wouldn't even be having this conversation...)

You have nine clean outs but two things can happen. If a brick hits the turn then you have 8 outs. And if he makes a full boat on either the turn or the river your hand is no good. So it's hard to say exactly how many outs you have but due to the fact that he has redraws, your odds to win the hand goes down fairly significantly.
